Terms of Use for Creators
Account, campaign, content, remuneration, licence and payout rules for MyLaura creators.
1. Scope and parties
These terms govern a creator’s use of MyLaura. The operator is Linksta s. r. o., Fraňa Kráľa 21, 811 05 Bratislava – mestská časť Staré Mesto, Slovenská republika, Company ID 56972024, Tax ID 2122530245, VAT ID SK2122530245. The contract is formed by completing registration and accepting the terms; a particular collaboration is formed only upon acceptance of a campaign or another unambiguous confirmation of the displayed campaign terms.
MyLaura facilitates collaboration, campaign management, review of deliverables and settlement. The brand is responsible for its products, claims and brief; the creator is responsible for the content created and published.
2. Eligibility and account
MyLaura may verify the public Instagram profile through Apify and store the profile photo and available metrics. An unverifiable or untruthful profile may prevent completion of onboarding or lead to account suspension.
- The creator must provide truthful, complete and current onboarding data.
- The Instagram account must belong to the creator or the creator must be authorised to manage it.
- The creator must not give an unauthorised person access to their sign-in, device or session.
- Changes to contact details, tax status or payout status must be updated without delay.
3. Independent status
The creator acts independently, and no employment, agency or partnership relationship with Linksta s. r. o. or the brand is formed. The creator is responsible for their own permits, taxes, contributions and business obligations that apply to them.
4. Applications and invitations
The creator may apply to participate or receive an invitation. Neither an application nor an invitation promises selection or earnings. Acceptance or rejection is stored and displayed in the campaign and communication with Laura.
Before accepting, the creator must check the brief, platform, type and number of deliverables, deadlines, remuneration, PPV/CPC rules, licence and special restrictions. By accepting, they confirm that they can fulfil them.
5. Campaign acceptance
After acceptance, the relevant commercial parameters are assigned to the creator’s particular participation. A change to a material requirement, rate or licence requires new confirmation if it goes beyond the terms already accepted.
The creator has no automatic entitlement to a campaign, continuation of a campaign or remuneration beyond verified fulfilment and the displayed limit.
6. Brief and content plan
The creator must comply with required claims, prohibited claims, format, platform, advertising disclosure, number of deliverables and schedule. If the brief is unclear or legally risky, they must request clarification before production.
The plan may include a recommended time, a 24-hour window before and after it, a cooldown between Stories or other steps, and a final deadline. A locked step may not be published earlier merely to publish all deliverables at once.
7. Review, rejection and correction
Content may undergo technical, content, legal, brand-safety and brief review. The result may include category ratings, a specific reason, a required correction and a resubmission deadline. Laura may explain this data and recommend the next step, but does not change the recorded decision.
The creator may resubmit content if revision is permitted. Repeated failure to meet objective requirements, missing a deadline or serious prohibited content may end participation without performance remuneration for the unfulfilled deliverable.
8. Publication and deadlines
The creator must publish only approved content and submit a truthful public URL or other required evidence. Publication after the hard deadline may be rejected. MyLaura may send a reminder two days before, one day before and on the deadline date; failure to receive a reminder does not cancel the deadline displayed in the campaign.
Content must remain available for the period stated in the campaign. Early removal, hiding or modification may suspend tracking and settlement unless it results from justified platform action or an agreed remedy.
9. Advertising disclosure
The creator must disclose advertising clearly, visibly and in accordance with the law, brief and social network rules. They must not make a false claim of personal experience or a health, environmental or performance claim without an appropriate basis.
10. PPV and performance remuneration
The calculation uses public metrics available through Apify or another notified source. Temporary unavailability of a social network may delay settlement. If a minimum guarantee is agreed, actual PPV and CPC remuneration is counted towards it and only the positive difference is paid after all deliverables are fulfilled.
- PPV is active only in a campaign that expressly specifies it.
- Tracking is activated only after content approval and verification of the public Instagram Reel URL.
- The current view count at activation is the baseline; earlier views are not paid.
- Only positive verified increases above the baseline during the displayed tracking period are remunerated.
- The rate is displayed as EUR per 1,000 views and is frozen for the participation upon acceptance together with the tracking period.
- Each Reel has a displayed maximum creator earning cap; remuneration tracking ends when it is reached.
- A decrease in the number from an external source does not itself create negative views, but proven fraud may lead to a correction.
- Purchased, bot-generated, artificially stimulated or otherwise manipulated views, clicks and conversions are ineligible.
11. Wallet and payouts
Remuneration may initially appear as pending. It becomes available after verification of fulfilment, completion of necessary tracking and settlement of the campaign. A payout requires a valid Stripe Connect account or an approved direct bank payout method, fulfilment of applicable compliance requirements, the minimum amount displayed in the app and an available balance.
The creator is responsible for correct payout and tax data. Stripe processes bank or card data in the Stripe flow; for direct bank payouts, MyLaura stores the IBAN encrypted. MyLaura may withhold a disputed amount, but not the undisputed portion without a reason. Wallet history records credits, corrections, refunds, platform fees and payouts.
12. Copyright and licences
The creator remains the author of their original content. By accepting a campaign, they grant the brand a non-exclusive licence within the scope displayed before acceptance, at least for reposting and organic sharing of the campaign during the agreed period. Paid advertising, modifications, sublicensing, whitelisting or use without a time limit must be expressly stated.
MyLaura receives a non-exclusive licence necessary for uploading, review, display, archiving evidence and dispute resolution. The creator warrants that they hold the rights to music, images, persons and other elements they have included in the content.
13. Prohibited conduct
- fraudulent metrics, bots, click farms or hiding the true source of traffic;
- illegal, hateful, discriminatory, violent or sexually exploitative content;
- infringement of copyright, personality rights, consumer rights or trademarks;
- disclosure of confidential brand information or personal data without a legal basis;
- circumventing MyLaura in an already accepted campaign to avoid agreed rules or fees.
14. Suspension and termination
The creator may close the account after completing or properly handing over active obligations. Linksta may temporarily restrict an account for a security risk, fraud, serious breach, unverifiable identity or an order from an authority. Where possible, we will notify the reason and allow a response.
We will give at least 15 days’ notice of ordinary termination by us; immediate termination is possible for a serious breach, fraud, illegality or imminent risk. Accrued undisputed entitlements remain preserved.
15. Liability
MyLaura does not guarantee campaign selection, view counts, earnings or uninterrupted availability of external social networks. Each party is liable for damage caused by breach of its obligations. Limitations of liability do not apply where the law does not permit them, particularly in cases of intent, gross negligence or harm to statutory rights.
16. Complaints and governing law
A complaint may be submitted through in-app support or in writing to the operator. Data protection matters are handled at [email protected]. The law of the Slovak Republic applies, and mandatory consumer rights remain unaffected.
17. Changes
We will notify material changes in advance in the app or by email. A change to an already accepted campaign will not affect frozen commercial parameters without the affected creator’s consent, except for a change required by law or a necessary security remedy.
